Please read these Terms carefully before using ARA. They describe what you can expect from us, what we expect from you, and how we handle the important details — payments, data, liability, and ending the agreement.
01 Acceptance of Terms
These Terms of Service ("Terms") govern your access to and use of ARA's AI receptionist services, dashboard, and related applications (collectively, the "Services") operated by ARA ("we", "us", "our"). By creating an account, signing an order form, or using the Services, you agree to these Terms.
If you are using the Services on behalf of a business, you represent that you have authority to bind that business to these Terms.
02 Description of Services
ARA provides an AI phone receptionist ("Hala") that answers inbound calls, conducts conversations in Arabic and English, and creates bookings in your ARA dashboard. The Services include the web dashboard, telephony routing, voice profiles, post-call transcripts and summaries, and associated APIs and integrations.
The Services are provided on a subscription basis. Specific features, usage limits, and pricing are described on our pricing page and in your order form.
03 Account Registration
To use the Services, you must create an account and provide accurate, current information. You are responsible for all activity under your account, for safeguarding credentials, and for ensuring your team members comply with these Terms.
04 Acceptable Use
You may not use the Services to:
- Violate any law, regulation, or third-party rights.
- Send spam, conduct unauthorized outbound dialing, or use the Services for deceptive purposes.
- Attempt to reverse engineer, scrape, or bypass rate limits, security measures, or API restrictions.
- Upload or process data you are not legally permitted to process.
- Interfere with or disrupt the integrity or performance of the Services.
05 Subscription and Payment
Fees are billed in advance according to your selected plan, either monthly or annually. Fees are non-refundable except where required by law or explicitly stated in these Terms. Overages (e.g., additional AI minutes) are billed at the rates listed in your plan.
We may update pricing from time to time. For active subscriptions, price changes apply at the start of the next renewal term after at least 30 days' notice.
06 Free Trial
We may offer a free trial for new accounts. Trials are for evaluation purposes, subject to usage limits, and may be modified or ended at our discretion. After the trial, your subscription begins automatically unless you cancel.
07 Cancellation and Refunds
You can cancel your subscription at any time from your dashboard. Cancellation takes effect at the end of the current billing period. We do not offer refunds for partial billing periods. If you are subject to local consumer protection law that grants a right of withdrawal, that right applies notwithstanding the foregoing.
08 Your Data
You retain all rights to data you or your customers provide to the Services ("Customer Data"). You grant us a limited license to process Customer Data solely to provide and improve the Services and as described in our Privacy Policy. We act as a data processor on your behalf with respect to Customer Data.
You are responsible for obtaining any necessary consents from your end customers (for example, call recording notices) and for ensuring your use of the Services complies with applicable laws.
09 Intellectual Property
The Services, including software, models, voice profiles, documentation, and branding, are owned by ARA and protected by intellectual property laws. Except for the limited right to use the Services under these Terms, no rights are granted to you.
Feedback you provide about the Services is non-confidential; we may use it without obligation to you.
10 Confidentiality
Each party may have access to the other's confidential information. Each party agrees to protect the other's confidential information using the same care it uses for its own, and to use confidential information only to perform under these Terms.
11 Warranty Disclaimer
The Services are provided "as is" and "as available" without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, and non-infringement. AI-generated outputs may contain errors; you are responsible for reviewing bookings, transcripts, and summaries before relying on them for business-critical decisions.
12 Limitation of Liability
To the maximum extent permitted by law, ARA's total aggregate liability arising out of or related to the Services will not exceed the fees you paid to us in the twelve (12) months preceding the event giving rise to the claim. In no event will we be liable for indirect, incidental, consequential, special, or punitive damages, or for lost profits, revenues, or data.
13 Indemnification
You agree to defend and indemnify ARA against any claims, damages, and expenses (including reasonable legal fees) arising from your use of the Services in violation of these Terms, your Customer Data, or your violation of applicable law.
14 Suspension and Termination
We may suspend or terminate the Services if you breach these Terms, fail to pay, or use the Services in a way that poses a security or legal risk. On termination, your right to access the Services ends, and we will delete or return your Customer Data in accordance with our Privacy Policy, subject to our legal retention obligations.
15 Governing Law
These Terms are governed by the laws of the Kingdom of Saudi Arabia, without regard to conflict-of-law principles. Any dispute will be resolved by the competent courts of Riyadh, unless your local mandatory consumer law provides otherwise.
16 Changes to These Terms
We may update these Terms from time to time. If changes are material, we will provide reasonable notice via email or the Services. Your continued use of the Services after the changes take effect means you accept the updated Terms.
